供雙重國籍人士使用之建議 (Chinese Traditional)

何謂雙重國籍? 

雙重國籍人士持有多重國籍。 

對於是否屬於雙重國籍,取決於澳洲及其他國家的法律。 

如果屬於下列情況,則可能是雙重國籍人士: 

  • 父母屬於另一個國家的公民 
  • 與另一個國家的公民結婚 
  • 申請並獲得另一個國家的公民身份 
  • 於海外出生。 

即使個人並不接受,某國家仍可視其爲該國的公民。許多國家不會容許公民放棄自己的國籍。某些國家僅會透過正規程序,才容許公民放棄國籍。 

某些國家並不承認雙重國籍。 

旅行前,請向相關國家/地區的大使館或領事館確認: 

  • 您自認爲可能是公民 
  • 相關國家過往曾將自己驅逐。相關國家可能不容許您返回。 

護照及簽證 

澳洲護照是澳洲公民身處海外的最佳證明。 

出入境澳洲 

出入境澳洲期間,請使用澳洲護照。 

您可能會因持有外國護照入境澳洲而遇上問題。如果並無持有下列證件,航空公司未必會允許您登機 

  • 澳洲公民證明 
  • 澳洲護照 
  • 有效簽證。 

離開澳洲後,您可使用其他國家的護照旅行。

 進出您的另一個國籍國

對於另一個所持國籍的國家,您可以使用該國護照出入。 

如果您使用該國護照,當地政府機構未必會視您爲澳洲人,因而限制澳洲政府協助您的能力。 

某些國家會對離境公民施加規則,您可能因此需要出境許可證或簽證。 

旅行前,請向所在國家/地區的大使館或領事館諮詢。 

雙重國籍人士的兵役義務 

有些國家要求其公民履行兵役義務。如果您前往該國,則可能須服兵役。 

該國可能會容許您短暫拜訪,而無須開始服兵役。或者,您可能於抵達時就須開始。 

如果您拒絕服兵役,就屬違法。即使已超過服兵役的年齡,該國仍可能會以違約者的身份將您拘捕。 

請與該國大使館或領事館了解服兵役的義務。離開澳洲前,請以書面形式獲取此類建議,並隨身攜帶副本。 

獲取海外醫療服務

某些國家/地區可能會允容許您以公民身份使用公共醫療保健,但身爲公民並不表示您可使用當地的服務,尤其並非居住於當地或並無納稅。

即使是前往持有國籍的國家,亦應獲取涵蓋醫療保健的旅行保險。

請參閱旅遊保險建議。

婚姻、離婚及子女監護權 

雙重國籍使婚姻狀況、離婚及子女監護權問題更為複雜。 

  • 如果海外締結的婚姻符合澳洲法律,就會獲澳洲承認。然而,某些政府機構並不接受外國證書作爲更改姓名的證明。 
  • 於澳洲締結的婚姻並不總能獲其他國家承認。 
  • 某些國家不承認於澳洲解決的離婚問題。 

如果您擔心婚姻或離婚方面的承認問題,請向另一個國家的大使館或領事館查詢。  

雙重國籍可能會影響法庭對子女監護問題的判決,尤其是當父或母一方希望離開澳洲。 

如要攜同子女離開澳洲,則須獲得父或母另一方的同意。不然,就可能會被指控綁架兒童。 

請參閱於海外結婚及攜同子女旅行方面的建議。另請參閱婚姻建議頁面(律政部,英文即「Attorney General's Department」)。 

雙重國籍人士領事服務 

雙重國籍會影響澳洲政府於海外協助的方式及時機。如果您身處於另一個國籍國,該國政府未必會容許澳洲政府提供相關協助。 

如果於海外需要協助,請先聯絡當地服務資源,您或許能以公民身份獲得支援。

於澳洲公民的另一個國籍國,澳洲政府提供以下服務 

  • 提供澳洲護照服務。 
  • 使文件獲得法律許可。 
  • 提供當地講英文的醫生或律師清單。 

於澳洲公民的另一個國籍國,澳洲政府無法提供以下服務 

  • 如果另一個國家之政府並不視您爲澳洲人,澳洲政府就無法提供領事協助。 
  • 澳洲政府無法讓您免服兵役。或者當您遭他人指控爲違約者,澳洲政府亦無法協助您離開監獄。 
  • 如果您遭他人拘捕,澳洲政府無法協助您擺脫困局。 
  • 澳洲政府無法提供法律建議。
