给双重国籍国民的建议 (Chinese Simplified)

什么是双重国籍国民?

双重国籍国民在多个国家拥有国籍。

您是否是双重国籍国民取决于澳大利亚和其他国家的法律。

如果您有以下情况,则可能是双重国籍国民:

  • 父母一方是其他国家的国民
  • 与另一个国家的国民结婚
  • 申请并获得另一个国家的公民身份
  • 在海外出生。

某个国家可以将您视为国民,即使您本人并不接受。许多国家不会让您放弃您的国籍。有些国家只允许您通过正式程序放弃国籍。

有些国家不承认双重国籍。

如有以下情况,旅行前请咨询目的国的 大使馆或领事馆:

  • 您认为您可能是该国国民
  • 该国曾经驱逐了您。他们可能不允许您再次入境。

护照和签证

身处海外时,澳大利亚护照是澳大利亚公民身份的最佳证明。

离开和进入澳大利亚

进出澳大利亚时使用您的澳大利亚护照。

持外国护照进入澳大利亚可能会遇到问题。如果未能提供以下任何一个证件,航空公司可能不允许您登上飞往澳大利亚的飞机:

  • 澳大利亚公民身份证明
  • 澳大利亚护照
  • 有效签证。

离开澳大利亚后,您可以使用另一个国家的护照旅行。

进入和离开您的其他国籍国

您可以持其他国籍国的护照进入和离开该国家。

如果您使用该国的护照,地方当局可能不会将您视为澳大利亚人。这可能会限制澳大利亚政府帮助您的能力。

一些国家对出境国民有规定。您可能需要出境许可或签证。

 在旅行前,请咨询您的其他国籍国的 大使馆或领事馆。

双重国籍国民的义务兵役制

一些国家要求其公民服兵役。如果您访问该国,您可能需要服役。

您的另一个国籍国可能会让您短暂到访而无需开始服兵役。也有可能在到达后您就要立即服役。

如果您不服兵役,即属违法。他们可能会将您作为逃役者逮捕。即使您已经过了服兵役的年龄。

向您的其他国籍国的 大使馆或领事馆确认您的兵役职责。在离开澳大利亚之前获得书面说明。随身携带一份副本。

获得海外医疗保健

某些国家可能允许您以国民身份使用公共医疗保健。但是,作为国民并不总是意味着您可以使用本地服务。特别是如果您不在那里居住或纳税。

购买涵盖医疗保健的旅行保险。即使您要去一个您拥有国籍的国家。

结婚、离婚和子女监护权

双重国籍会使结婚、离婚和子女监护权变得更加复杂。

  • 如果符合澳大利亚法律,澳大利亚承认在海外缔结的婚姻。但有些机构不接受外国证书作为更名的证明。
  • 在澳大利亚缔结的婚姻并不总是在其他国家得到承认。
  • 一些国家不承认在澳大利亚办理的离婚。

如果您担心自己的婚姻或离婚是否会得到承认,请询问您的其他国籍国的大使馆或领事馆。 

双重国籍会影响法院对儿童监护权的裁决。特别是如果父母一方想离开澳大利亚。

您必须征得父母中的另一方的同意才能与您的孩子一起离开澳大利亚。否则,您可能会被指控绑架儿童。

双重国籍国民的领事服务

双重国籍会影响我们在海外为您提供帮助的方式和时间。如果您在其他国籍国,他们的政府可能不会让我们为您提供帮助。

如果您在海外需要帮助,请先联系当地资源。您也许可以作为国民获得支持。

我们可以在您的另一个国籍国做些什么

  • 我们可以提供澳大利亚护照服务。 
  • 我们可以进行文书认证。 
  • 我们可以为您提供当地讲英语的医生或律师的名单。 

我们在您的其他国籍国不能做什么

  •  如果他们的政府不认为您是澳大利亚人,我们无法提供领事帮助。 
  • 我们无法让您不服兵役。如果您被指控为逃役者,我们也无法让您出狱。
  •  如果您被逮捕了,我们无法让您摆脱困境。 
  • 我们无法为您提供法律建议。
